Nissan accuses Carlos Ghosn of new malfeasance

Nissan is launching a new charge against Carlos Ghosn. The japanese manufacturer and its partner, Mitsubishi confirmed this Friday press information according to which the boss of Renault was paid by Nissan Mitsubishi BV (NMBV), the structure joint to the two vehicle manufacturers in the netherlands, a compensation of € 7.8 million, without informing the other two directors of the entity.

Owned equally by Nissan and Mitsubishi Motors, the co-company NMBV had been founded in June 2017 with a mission to "explore and promote synergies within the partnership," explains Nissan in a press release. After an internal investigation, the automaker claims to have discovered that Carlos Ghosn has signed a work contract with NMBV, and that under this contract, it has received "a total amount of 7.822.206,12 euros (including all taxes) in compensation and other payments". "Despite the clear requirement that any decision relating to the remuneration of the directors and the contracts of employment specifying the compensation must be approved by the board of directors of the NMBV, Carlos Ghosn has concluded the contract without any discussion with the other members of the board: Hiroto Saikawa, CHAIRMAN of Nissan, and Osamu Masuko, CEO of Mitsubishi Motors (...) Saikawa and Masuko have not received any compensation or other payment of NMBV," says the manufacturer. Nissan and Mitsubishi, which represent a "fault", have announced that they plan to "take measures" to recover this sum from Carlos Ghosn. A civil suit is being considered, according to a source close to the folder.

a week ago, Nissan had already announced the filing of a criminal complaint against its former chairman "on the basis of misuse by Carlos Ghosn a significant part of the funds of the company". This complaint was made following a second review of the officer by the prosecutor's office of Tokyo, which is supposed to have reduced its revenues between 2010 and 2018, and accused him of abuse of confidence for the worse, the boss who passes on the accounts of Nissan losses on personal investments. Nissan says that Carlos Ghosn has engaged in other malpractices such as purchase of luxury residences in Beirut, Rio or Paris, donations to universities in Lebanon, or the employment dummy of his sister in Brazil, all at the expense of the manufacturer. For the moment, the public prosecutor did not withhold these latest accusations.

The previous indictments are already hovering on Carlos Ghosn, the threat of a prison sentence of maximum 15 years. His lawyers have made several attempts to obtain his release on bail, to no avail. A new refusal has been inflicted by the court on Tuesday and call, made Thursday, has also been rejected. This Friday, the legal team of the boss of the Alliance, led by Motonari Otsuru, is still trying his luck with the filing of a "special appeal before the supreme Court". If it is validated, Carlos Ghosn could be released on bail, but restrictions on travel may be imposed. Conversely, if the new application fails, the leader may remain in prison until the 10th of march, and then see his prolonged detention periods thereafter for a month on the request of the prosecutor. The boss of the Alliance is likely to remain behind bars until his trial, which will not take place before several months.

In the meantime, Carlos Ghosn has been dismissed from the presidency of the boards of directors of Nissan and Mitsubishi Motors. For its part, Renault, is officially set out in search of a successor, in the wake of a call by the French State for a new governance. "Since the unavailability of the CEO seems set to continue, we now have the responsibility of taking sustainable actions," said the Figaro Philippe Lagayette, senior independent director of the group, which provides temporarily his chair.
