Neither eyewitness shows up for Wilson shooting trial

Neither of the two eyewitnesses who could link Tchella Bellamy to a Wilson Borough shooting showed up to court Monday.

As a result, Bellamy's shooting re-trial was postponed to Oct. 31.

Bellamy, 20, of Easton, is charged with shooting Shane Walden and Lahteek Smith about 1 p.m. July 20, 2014, on a porch at 1505 Washington St. 

A trial in January resulted in a hung jury. Drug dealer Tashaun Smith and witness Chynna Ravitz were expected to testify during the trial scheduled to start Monday.

But prosecutors learned that Ravitz allegedly received a phone call from Northampton County Prison inmate Baysone Erskine telling her, "when it comes time for the trial, get missing."

Prosecutors are investigation that claim and are weighing whether to charge Erskine with a crime.

If the witnesses keep failing to show up, Assistant District Attorney Patricia Fuentes Mulqueen could run out of time for a retrial. She had 120 days from the end of the first trial, although defense attorney James Brose has appeals pending with the state Superior Court.

It's unclear whether the days count after Brose filed the appeal, but he made it clear Monday that he is prepared to go to trial when Mulqueen is ready.

Asked whether Mulqueen will have warrants issued to bring in Ravitz and Smith as material witnesses, she said "We have some issues we're working out."

It's unlikely Mulqueen or Brose will be available to try the case Oct. 31 anyway. Both are scheduled to handle the homicide trial of Quadir Taylor. It's unclear what will happen if the Taylor trial starts as scheduled Oct. 31.
