Finally, more data protection – this is promise of European Data Protection Basic Regulation (DSGVO), which will be enforced on 25 May in EU Member States. But two weeks before deadline, re are still many contentious issues and plenty of discussion. What DSGVO is and what is changing, we had already explained in a first article. In following FAQ we take up some of most important questions from consumer point of view.

Do I have to accept new terms and conditions of online services?

Anyone who wants to continue using online services like Google, Streamingdienste like Netflix, apps like WhatsApp or social networks like Facebook, must continue to add ir terms and conditions. Of course, all users can reject new general terms and conditions if y do not enjoy m. But n you may not be able to use respective services more or only limited from May 25th onwards.

Does DSGVO change practice of collecting data?

Not really. Facebook and or social networks and online offers may continue to collect personal information. You may continue to use m to display personalized ads on ir basis. The user agrees with confirmation of terms of use (even if y can change this on Facebook in advertising preferences again). Companies may also pass on data if re is a "legitimate interest" or if it serves to pass on a contract.

    So nothing changes?

A bit changes already; Companies cannot leave everything to old. For example, you must write your general terms and conditions easily and in simple language. You need to explain for what purposes you collect and process data. You may not automatically make use of a service to a newsletter – so far This is a popular practice for online shops and sweepstakes. And you need to delete and offer data for download. Last but not least, many online services are considering what data y share with third parties before starting DSGVO. For example, both Facebook and Apple are currently reviewing which third-party apps actually collect what data — and may restrict access to it.

How can I request my data with help of DSGVO?

The user can at any time request personal data that a website has stored about him – wher it is a small blog, an online shop like Zalando, app of Deutsche Bahn or Facebook. Companies must not only hand over information mselves to requestors, but also, on request, explain purpose for which data is used. For example, cover letter templates provide consumer centers or website your data, your rights, which is sponsored by Federal Ministry. Within a month, companies must provide information.

In settings, Facebook users can view data stored about m. © screenshot

On Facebook, users can find m in settings under your Facebook information. Here you can view activities such as likes or your own payment history, download your data or delete your account including all information. Google also offers such a feature: Under My account, search engine displays item control content. Similar settings are available for all or services, but y are partially hidden.

And when can I delete data?

The deletion of data is also an innovation that comes into effect through DSGVO. Users can have ir information removed if y are no longer used for current processes. A company would need data such as address or account number, for example, if user ordered something from online shop that has not yet been delivered. However, if a user no longer wants to be active on website, companies must remove all previously stored data from ir servers. Anyone who has ever tried to delete a Facebook account knows that it was not that easy before new law came into force.
