The US group accuses its South Korean competitor of having copied the iphone and ipad. After seven years, they have now settled out of court.

Smartphones: Apple and Samsung submit years of patent dispute

Apple had just designed its iphone, as Samsung already brought a strikingly similar smartphone to market in technology and design. This resulted in a patent war with some 50 procedures in several countries. After seven years, two companies in San José California settled out of court. The competent Judge Lucy Koh ordered cessation of proceedings on Wednesday (local time). The terms of agreement were not known.

In procedure that has now been set, Apple had received a good $1 billion from Californian juror 2012. Samsung n appealed, case went up to Supreme Court of USA. It decided that a part of sum had to be renegotiated. However, Apple also decided to do this round – jury spoke to group in May 539 million dollars. Samsung refused to contest this decision with out-of-court agreement.

For Steve Jobs, Android was a "stolen system"

Apple founder Steve Jobs wanted to defend position of Apple in smartphone business with lawsuit of 2011: The iphone had mobile phone industry with its large touchscreen and renunciation of a keyboard transformed. But relatively quickly, among or things, Samsung devices came to market with Google operating system Android with similar functions and similar optics. Jobs called Android according to his biographer Walter Isaacson as a "stolen system" and moved against market leader Samsung in court.

The decision of jury in August 2012 was at first glance a triumph for Apple. They found that Samsung had infringed with several devices protected design patterns of iphone. Even typical appearance of screen surface with app icons was copied. The same was true for operation: if you want to zoom in on content with a Samsung smartphone, you have to double-tap it or pull it apart with two fingers – just as with Apple, who have patent for it.

The procedure briefly ensured that some of se operating functions of Android phones disappeared. However, providers quickly found ways to circumvent patents. Because product cycles in smartphones are so short, even for Apple, positive court decisions or sales bans on competition could have little impact. Samsung remained world's largest smartphone provider – and Apple is only regularly overhauled in Christmas quarter when new iphone models are launched. At same time, Apple secures most of profits in smartphone business.

In competition of operating systems between Google and Apple, it happens again and again that y follow up on annual updates features that were initially introduced to competition.
