The exonerated signed a documentation whose small print was unknown until a bank claim came to him

The Court of First Instance and Instruction No. 2 of Arucas (Las Palmas de Gran Canaria) has issued the Benefit of Exoneration of Unsatisfied Liabilities (BEPI) in the case of a local couple, who has thus been freed from a debt that amounted to 100,944 euros, thanks to the Second Chance Law. Both went to Repara tu Deuda, the first office that applies the Second Chance Law in Spain, drowned by the situation in which they found themselves. After studying the case, the lawyers from Repara tu Deuda began the procedures so that they could take advantage of the Second Chance Law. Now they are freed from 100% of their debts.

The reason for his insolvency dates back to 1995. They made him sign a document that, in theory, was to get a house. Without his knowledge, other documents were included that turned out to be credits in his name as guarantor and of which the debtor became aware a few years later when he received a bank claim. Subsequently, the corresponding legal proceedings began.

Debt cancellations are taking place every day in one of the different autonomous communities of Spain. This is causing many people who are blocked by their debts to resort to the Second Chance Law and request the services of specialized lawyers in the country. According to the lawyers of Repair your Debt, "the Second Chance Law is entering Spanish homes with force. And it is that many have already directly verified the great benefits of being exonerated from their debts, registering assets in their name, leaving delinquency lists and accessing new financing".

The lawyers of Repara tu Deuda, specialists in the Second Chance Law, have already managed to exceed the figure of 130 million euros exonerated to their clients. This leads them to be, apart from pioneers, leaders in their application. Among the keys to success, "having the best lawyers in this legislation, using optimal digital technology available to everyone and never forgetting the human component, so necessary in a very distressing process for so many."

The Second Chance Law allows individuals and the self-employed to be exonerated from their debts if they previously meet a series of conditions. Thus, it is essential that the bankrupt always act in good faith, being transparent throughout the entire process, that the amount of the debt does not exceed 5 million euros and that they have not been convicted of socioeconomic crimes in the last ten years.
