Ohio bill would allow scoop shops to sell boozy ice cream

COLUMBUS, Ohio -- Here's a twist on a root beer float -- cold Coca-Cola poured over a few scoops of Captain Morgan-flavored ice cream.

Joe Ericksen wants to put that and other alcoholic ice cream concoctions on the menu at his Conneaut ice cream shop Heavenly Creamery. A new bill would allow him to serve boozy ice cream and sell it to-go in small quantities.

Ericksen and his wife have been experimenting with adding alcohol to ice cream. His "sinful creations" include a piña colada with actual rum, rather than an extract, and a bourbon ball flavor mirroring Kentucky's finest.

Making alcoholic ice cream is already legal in Ohio. It's also legal to sell it. But liquor laws now prevent a business from doing both. 

Rep. John Patterson, a Jefferson Democrat, introduced a bill modifying the state's A-4 liquor permit, referred to as a bottler permit. Establishments with those permits can currently sell mixed drinks. House Bill 555 would permit ice cream between .5- and 6-percent alcohol by volume to be sold.

Full disclosure: Patterson has tried the bourbon ball ice cream.

"The bourbon was just enough you could taste it," Patterson said. "And it was delicious."

The ice cream tops out at around 3.5-percent alcohol by volume, making a pint equivalent to about four craft beers. So, yes, you could get drunk, but you'd probably get sick first.

"By the time you get to a gallon of ice cream, all that dairy and sugar in your stomach would probably make it the most miserable experience of your life," Ericksen said. "It's about having an enjoyable experience, not an overindulgence."

Ericksen said his customers are clamoring for the product, but without proven sales, it's a tough pitch to sell in grocery stores. And liquor distributors don't have freezers on their trucks to transport the ice cream.

Patterson said the ice cream is a product fit for Ashtabula County, part of Ohio's wine region where maple syrup producers sell bourbon-infused syrup.

"With that as a culture in our corner of the state, this is seen as a little way that my local entrepreneur can have a niche market," Patterson said.
