Tests on the sexual orientation of asylum seekers are too much in the way of privacy. They violated the Charter of Fundamental Rights, the ECJ ruled.

In examining ir application, asylum seekers may not be subjected to a test of ir sexual orientation following a judgment of European Court of Justice (ECJ). It is true that, according to ECJ, authorities are in principle allowed to commission opinions in order to better assess wher an asylum seeker actually needs international protection. These should, however, be in line with Charter of Fundamental Rights of EU and respect for human dignity and right to respect for private and family life, as prescribed rein.

Psychological tests on homosexuality concern " most intimate areas of life of asylum seeker". They were refore disproportionate to ir purpose and were not compatible with EU Charter of Fundamental Rights, ECJ ruled. This also applies if test is carried out only in agreement with asylum seeker, because it is under considerable pressure when it is approved.

The decisive case is a Nigerian who applied for asylum in Hungary. He said he was gay. Because of his sexual orientation, he fears to be persecuted in his home country. The Hungarian authorities did not find any contradictions in its information. Neverless, y rejected application for asylum on grounds that psychological opinion y had commissioned did not confirm ir sexual orientation.

If documents and documentation were missing to prove sexual orientation of asylum seeker, authorities could, among or things, rely on credibility of applicant's statements, Luxembourg judges now judge.
