An unjustly deported Afghan may return to Germany. The 23-year-old Haschmatullah F. Had been deported to Afghanistan in summer by a procedural error. The Federal Office for Migration and Refugees (BAMF) had allowed its deportation, although a urgent of his lawyer against his deportation was pending at administrative court in Sigmaringen. Such applications grant deportation protection.

The authorities have now reversed mistake and arranged return of man. According to information from German press agency, man will fly from Islamabad in Pakistan and land first in Frankfurt. From re he will continue to go to Tübingen, where he will be expected to have a press conference with his lawyer Markus Niedworok in evening. After that, his asylum procedure is to be resumed.

A spokeswoman for bamf, who is responsible for organisation of repatriation, said: The return of asylum seeker will continue to operate in cooperation with Foreign Office. Wher it is first case of this kind could not be confirmed at first.

Deportation stop went between court and bamf lost

The person concerned himself was happy about decision. He "go back to a new life," he said. "Here in Afghanistan, I have no place to live." He has been hiding in Kabul since his deportation. His bror helped him. He hopes that he can stay in Germany this time. "This time I want to learn German better, find work, pay taxes and serve German government, which is so kind to me."

According to his lawyer, Haschmatullah F. Arrived in Germany on June 3. On 8 June he had applied for asylum, but was rejected with his request, referring to fact that he had come to EU via Bulgaria. According to so-called Dublin rules, Bulgaria was responsible for its asylum procedure. Against this decision, Niedworok had appealed to Administrative court in Sigmaringen on 2 August.

As long as such a urgent is in world, it must not be deported, said Niedworok – but information on current proceedings was probably lost between court and bamf. The bamf released deportation of F. to Bulgaria. The court n ordered that it be returned, but Bulgarian authorities had already flown him to Afghanistan.
