In an illegal car race in Cologne, a cyclist died in 2015. The District Court has now suspended the probation penalty for the two men.

In Cologne revision process for death of a cyclist in an illegal car race, two speeders have to go to prison. The Cologne district Court ruled that imprisonment sentences already imposed were not subject to probation due to negligent killing. The Federal Supreme Court had abolished original probationary judgments.

The judges thus followed request of Prosecutor. The "special circumstances" prescribed for probation were not given, said prosecutor before District Court. Originally, anor Chamber of court sentenced speeders to prison sentences of two years or 21 months for negligent killing, but suspended penalties for probation.

The Federal Supreme Court had suspended parole in July 2017. The BGH argued that accused caused death of cyclist negligently, but race was deliberately driven. By ir aggressive way of operation, y would have deliberately caused danger.

The defendants who were 21 and 22 years old had delivered a car race at a high speed in Cologne in April 2015. One of cars was spinning in a corner and captured a 19-year-old student on bike path. She died three days later from her severe head injuries.
