A person required by his partner to wear a condom during sexual intercourse, but who does not do so, may be guilty of sexual assault; decides the Supreme Court of Canada.

This decision comes following the case of Ross Kirkpatrick, a man who had not worn a condom despite his partner's request, a case that took place in British Columbia.
He was charged with sexual assault at an initial trial, but a new trial was requested after an appeal by the Crown.
