The second witness to a Bets10 fatal shooting in a South Side driveway in 2014 testified Wednesday that she heard nine gunshots, ducked for cover, then called 911 to report the incident.

But Paige Gerber told the Bexar County jury hearing the murder case against Dustin Lee Osborne that she didn't see who pulled the trigger, and “just assumed” the shooter was her ex-boyfriend, Gabriel Aguilar.

Osborne was 19 when he was arrested in the shooting death of Ralph Michael Lopez, 34, of San Antonio, on Aug. 11, 2014. He is the first of two defendants to go to trial. Aguilar, Osborne's uncle, also is charged with murder and is out on bond, awaiting trial.

At the time of his death, witnesses told police that Lopez and Aguilar, now 42, had argued over a woman shortly before the shooting.

Gerber's cousin, Savannah Hardy, told the jury Tuesday that she wanted to leave, but Gerber did not, so she called Aguilar to get them from Lopez's house, but Gerber would not leave.

Hardy said she was in a pickup truck with Aguilar, Osborne and another woman when she saw Lopez punch Aguilar through the driver's side window. Aguilar allegedly then told Osborne, "Shoot him," and Hardy said she saw Osborne, now 22, point and shoot a gun from the back seat of the pickup.

Lopez was shot multiple times and later died at San Antonio Military Medical Center.

If convicted of murder, Osborne faces a maximum of life in prison.

The case is being heard by Judge Jefferson Moore in the 186th state District Court.
