No matter which taxi you go to, the fare is set. This principle has now been softened by the Federal Supreme Court, and certain concessions have been allowed.

Taxi apps like MyTaxi are allowed to continue to offer discount promotions such as half-price rides. This far-reaching judgement was made by Federal Supreme Court in Karlsruhe. The discount campaigns did not violate price fixing in taxi trade, BGH decided in last instance. The taxi driver receives full fare and company itself is not a taxi operator.

Even an unfair behaviour for purpose of displacement of competitors does not occur because bonus actions were limited in time and were only in a few cities, said deputy chairman Judge Wolfgang Schaffert at sentencing.

The Co-operative taxi Germany, based in Frankfurt, had sued. It is a merger of classic taxi headquarters – and has now been lost to Daimler subsidiary MyTaxi. The Frankfurt Court of Appeal had decided orwise in dispute in 2017 and discount campaign of MyTaxi was prohibited.

The start-up company, which was founded in 2009, works toger with 18,000 taxi drivers in Germany. In years 2014 and 2015, re were four bonus promotions from MyTaxi in large cities where customers were able to drive half price. To do this, you had to book trip via smartphone app. The taxi drivers were reimbursed by MyTaxi for remaining fare, but had to pay an operator fee.

The taxi attendants argued that re was a price fixing in taxi industry, so taxi drivers could not offer cheaper rides. This is to secure supply. The peculiarity of mytaxi discount campaigns, however, is that taxi drivers – minus placement fee – receive full price, so y do not grant a discount. Rar, discount is paid by brokerage service.
