Airbnb: Berlin wants to allow Homesharing

In Berlin, apartments will be allowed to be rented to holiday guests for up to 60 days a year without permission, for example via platforms such as Airbnb or WIMDU. "We do not want to punish anyone if, during holiday, our own apartment is rented for a few days as a holiday apartment", Senator for urban development and housing, Katrin Lompscher, founded proposed bill. "In future, however, we want to take a more decisive approach to law against permanent, commercial use." The amendment to law is to come into force in May 2018, Lompschers. At first, RBB and Tagesspiegel had reported change.

With plan to change law, rental portals have won a victory in battle for so-called Homesharing. Many providers have professionalized; Many apartments were entertained solely for purpose of letting m profitably for short-term visitors.

This exacerbated rental market in many metropolitan cities and weakened local hotel industry. In order to prevent this development, many cities had legislated more stringently. Berlin has been particularly harsh with its Zweckentfremdungs Prohibition Act 2014: Since May 2016, tenants may only use ir apartment with exception of competent district office for or than residential purposes. In addition, citizens should report illegal holiday homes.

The amendment to law should now meet private providers, says RBB. In order to continue to avoid a misuse of purpose, authorities wanted to control rental more strongly. The registration number should only be issued for two years, and landlords should show how many times y have rented ir apartment. If you want to rent your apartment for more than 60 days a year, you still need an exemption. In event of violations, fines of up to 100,000 euros were threatened.

In view of shortage of housing in capital, stricter regulations are still planned against misuse of housing. For example, owners who leave ir flat vacant, instead of renting m, will have to reckon with restrictions after only three months of vacancy, instead of six months.

According to Urban Development Administration in Berlin, re are an estimated 20,000 to 30,000 apartments or rooms, which are rented partly for holiday purposes. The worldwide operator Portal Airbnb has, according to its own data, 26,000 accommodations for occasional rental.
